On 28 December 2013, Mr Gassan Al Kammessy was walking with his young daughter in Westfield Shopping Centre, Liverpool. He was injured when he slipped and fell on a wet patch on the floor in a public area of the Centre. The accident was captured on CCTV footage, and occurred at 10:44 am.

On 6 April 2014, Mr Larry Bridge slipped on water lying on the floor of an underground car park at premises occupied by Coles and fell, and suffered significant injury. At the time of the incident Mr Bridge was pushing a trolley through the car park. He had momentarily stopped to answer his mobile phone and continued walking and pushing the trolley with one hand.

On 4 April 2016, Ms Antonietta Giudice attended a Bunnings Warehouse in Ashfield, together with a friend and her grandson, who was almost four years old at the time. Ms Giudice’s grandson was taken to the play area by her friend while Ms Giudice was inspecting some furniture. She heard her grandson distressed so she walked over to the play area. She opened the gate with her right arm, stepped forward, and tripped and fell, landing on her right wrist. She suffered two fractures and underwent surgery to insert plates and screws into her arm.

In 1995, Matthew McDonald was born at Campbelltown Hospital under the care and management of obstetrician Dr S Ng. He is now 23 years of age. Matthew’s mother, Prudence, alleged that Matthew suffered a hypoxic event sustained during his birth causing him severe injury. She and Matthew both commenced proceedings in the Supreme Court of New South Wales against both Dr Ng and the hospital, in negligence and claimed damages. They allege that as a result of hypoxia, Matthew suffered hypoxic damage to his brain, and that Matthew’s evolving or acquired microcephaly, developmental delay, intellectual disability and cortical blindness are due to the birth-related asphyxia. A young man, who was driving on a dark, poorly lit road and was catastrophically injured when his vehicle collided with another vehicle turning across his path, has successfully sued the other driver, with the Supreme Court of Queensland finding the other driver negligent in failing to keep a proper lookout and failing to yield.
