Mr Kelleher was required to deliver batteries to customers, including batteries weighing over 20 kilograms. He received no manual handling training, and no training or instruction about the appropriate way to get into, or out of, his delivery truck.

On 8 July 2011, Ms Einas Nouri had an ultrasound at a private clinic in Canberra, National Capital Diagnostic Imaging (NCDI) and was told that she was pregnant with twins and with a gestation of 19 weeks and five days. Ms Nouri and her husband Musab Shaor were prepared to terminate the pregnancy if either twin was likely to be disabled, including a termination, if necessary, in respect of both twins.

In March 2009, Mr Phillip Eastment was a custodial corrections officer at the Maryborough Correctional Centre. On 8 March 2009, he and another officer were working in a secure area when a prisoner began to assault the other officer. Officer Eastment intervened and the prisoner began striking him as well and yelling threats at him.
