What is a standard will?

A Will is a document that sets out your wishes in the event of your death. A Will deals with things such as:

  • Appointing an Executor (the person who is responsible for managing and finalising your Estate after you pass away).
  • Gifting your assets to your choice of beneficiaries.  
  • Nominating a guardian to care for your children.
  • Nominating a person to care for your pets.
  • Directions regarding your funeral and burial arrangements.
  • And many other things.

There are also certain legal requirements that must be satisfied to ensure your Will is valid and our team of Estate Planning lawyers can guide you through this process and ensure that your Will satisfies all legal requirements.

What is a Power of Attorney? 

A Power of Attorney is a document that operates during your lifetime and allows you to appoint an Attorney who is authorised to manage your legal and financial affairs on your behalf.

You can choose whether it operates immediately, or only if and when you are unable to independently manage your legal and financial affairs.

Your Attorney can manage your bank accounts and sign documents on your behalf. They cannot change your Will, or use the Power of Attorney to benefit themselves in any way.

Your Attorney should be someone who is trustworthy, and who can be available to assist you if required.

If you don’t have an Attorney appointed, your family will need to undergo an often lengthy and complex process of applying to be appointed your financial manager, which involves making an application to the Guardianship Tribunal at NCAT. 

What is an Enduring Guardian? 

An Appointment of Enduring Guardian is a document that operates during your lifetime and allows you to appoint a Guardian who is authorised to manage your health and lifestyle affairs.

Your Guardian can only make decisions on your behalf if and when you are unable to make or communicate your decisions due to ill health.

Your Guardian can make decisions about where you live, what healthcare you receive, which personal services (such as home care or shopping services) you receive. Your Guardian can consent to medical treatments, have access to your medical records and depending on the scope of power you have given them, a Guardian can refuse consent to medical treatment in certain circumstances on your behalf.

You should have an Appointment of Enduring Guardian that sets out who you want to make your decisions on your behalf, and you can include information and directions to your Guardian about your wishes regarding organ donation, medical procedures, and life support.
