Reporting Injuries

A workplace injury must be reported to the employer as soon as possible. Failure to do so could jeopardise entitlements.  It is not initially necessary for a worker to complete a claim form as once the employer is advised of the injury, the employer is obliged to provide the information to the Workers Compensation insurer within 48 hours and the insurer should commence payment of compensation benefits within 7 days after being notified of the injury, (unless they have a reasonable excuse for not doing so).  Although it is only necessary for a claim form to be submitted if the worker will have more than 12 weeks of incapacity from work, Marsdens recommend that a claim form be submitted in any event.
