How much will my legal costs be?

Since 1 October 2012, unless a claim has already been made and the matter subject to resolution of a dispute before the Workers Compensation Commission prior to 31 March 2013, workers are required to pay their own legal costs.

If the matter was before the Commission prior to 31 March 2013 to resolve a claim previously made, then, on successful completion of the matter, legal costs will be paid by the insurer in accordance with regulated fees.

Should the matter not fall into the above category, then it is likely that your legal costs will be paid by obtaining grant funding through the Independent Legal Assistance and Review Service (ILARS)operated by the Workers Compensation Independent Review Office (WIRO).

We conirm that Marsdens are approved as a provider under the ILARS Scheme and, as such, is able to make applications for grant funding on behalf of a worker where a matter has merit.
